Terms of Service
The operating terms for organizations that evaluate or use the BlackCards platform.

1. Agreement and eligibility
By creating an account, accepting an order form, or using BlackCards, the customer agrees to these terms. The person accepting them confirms that they can bind the organization and that users are legally able to use the service.
2. The service
BlackCards provides tools to design, issue, operate, and analyze digital loyalty cards, including integrations with supported wallet providers. Features, limits, support, and service periods are determined by the selected plan and any signed order form.
The customer is responsible for its loyalty rules, rewards, locations, staff access, member communications, and compliance with consumer, marketing, privacy, and promotion laws.
3. Accounts and acceptable use
Customers must keep account and scanner credentials secure, assign least-privilege access, and promptly report suspected misuse. The service may not be used to violate law, infringe rights, distribute deceptive content, probe security, bypass plan limits, or harm the platform or a provider network.
4. Billing
Paid subscriptions begin after successful payment and renew for the interval shown at checkout unless cancelled under the applicable order. Fees, taxes, refund terms, overages, and price changes are governed by the checkout disclosure or order form.
5. Customer content and data
The customer retains ownership of its brands, program content, and customer data and grants BlackCards the limited rights required to operate, secure, support, and improve the contracted service. The customer confirms that it has the rights and notices needed to provide that content and data.
6. Wallet providers and third parties
Apple Wallet and Google Wallet are third-party services governed by their own terms and review processes. BlackCards does not control provider availability, device behavior, approval, notification presentation, or policy changes, and does not guarantee delivery or placement.
7. Availability, suspension, and termination
We may suspend access where reasonably necessary to address security risk, unlawful use, non-payment, provider requirements, or material breach. Either party may terminate as stated in an order form or for uncured material breach. Export and deletion rights are subject to the contract, law, and documented retention periods.
8. Warranties and liability
Except for express contractual commitments, the service is provided as available and without implied warranties to the extent law permits. Neither party is liable for indirect, incidental, special, or consequential loss where exclusion is lawful. Any liability cap, indemnity, governing law, and dispute forum must be completed in the applicable signed agreement.
9. Changes and contact
Material changes will be posted with a revised date and, where required, advance notice. Questions, notices, and legal requests can be submitted through the BlackCards contact form.
